RE: The tariff classification of grout cleaning brushes from China

Dear Ms. Pendris:

In your letter dated September 6, 2011, you requested a tariff classification ruling.

The submitted sample is identified as S/2 Grout Cleaning Brushes, SKU# 68610. This item consists of two brushes of identical size and construction. Each of the two brushes has a handle that is made of polypropylene (PP) plastic material and bristles that are made of polyethylene (PE) plastic material. One brush is of pink and white color and the other brush is of green and white color. Each brush features an easy grip handle and an aperture at the end of the handle to facilitate hanging when not in use. Each brush measures approximately 9¾” long.

These brushes are designed for the purpose of cleaning hard to clean areas such as the grout between tiles, shower door tracks and behind faucets. The item is designed to clean tiled countertops, tiled floors, tiled walls and tiled shower stalls As you requested, the sample will be returned to you.

The applicable subheading for SKU# 68610 will be 9603.90.8050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for…brushes…: other: other…other. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
